Terms of Service

These Terms of Service ("Terms") govern your use of the Se-EBikes website, mobile app, and bike-rental services (collectively, the "Service") operated in Culebra and Vieques, Puerto Rico. By making a reservation or signing the rental agreement, you accept these Terms.

1. Eligibility

You must be at least 18 years old to reserve and operate an EBike. You are responsible for ensuring anyone in your party who rides is also of legal riding age in their jurisdiction.

2. Reservations and payment

• Reservations are made through our website, mobile app, or in person at our pickup location.
• A valid payment method is required to reserve. We use Stripe to process payments; we do not store card numbers on our servers.
• The rental amount and Puerto Rico sales tax are charged when you pick up the bike, not at reservation time. A refundable security deposit is held against your card at pickup and released when you return the bike in the condition you received it.

3. Cancellation and refunds

• You may cancel for a full refund of any pre-paid amounts up to 24 hours before your scheduled pickup time.
• Inside the 24-hour window, the reservation amount may be retained.
• If you return the bike before your scheduled return time, we refund the unused full days (rounded up by full day — the rental increment).
• If you return after your scheduled return time, your card is automatically charged for the additional full days at the same daily rate.

4. Use of the equipment

You agree to:

• Operate the EBike lawfully, wear the supplied helmet, and follow Puerto Rico traffic regulations.
• Lock the bike whenever it is unattended using the lock provided.
• Return the bike to our designated pickup location at the end of your rental.
• Not transfer or sublet the rental to any other person without our written consent.
• Not modify the bike, remove safety equipment, or operate it on routes prohibited by local law (e.g. inside protected wildlife refuge zones where bicycles are restricted).

5. Liability and assumption of risk

EBike riding involves inherent risks. You acknowledge and accept those risks. To the maximum extent permitted by law, Se-EBikes is not liable for any injury, loss, or damage arising from your use of the Service, except where caused by our gross negligence or willful misconduct.

You agree to indemnify Se-EBikes against any third-party claims arising from your operation of the rental equipment.

6. Damage, loss, and theft

• Normal wear and tear is included in the rental.
• Damage caused by misuse or negligence may be captured in part or in full from your security deposit; if the damage exceeds the deposit, you are responsible for the additional amount.
• Theft or total loss of the bike: you are responsible for the documented replacement cost, less any insurance recovery we receive.
• You are required to report any incident, accident, or theft to us as soon as practicable.

7. Roadside assistance

If you encounter an issue during your rental — flat tire, mechanical failure, or you become lost — use the in-app roadside help button or call the number provided at pickup. We make reasonable efforts to dispatch help during operating hours.

8. Service availability

We reserve the right to cancel or modify reservations in cases of severe weather, mechanical issues, regulatory action, or other events beyond our control. In such cases we refund any amounts already charged for the affected portion of the rental.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes the data we collect and how we use it.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the website and apps. Continued use of the Service after a change constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Puerto Rico. Any disputes will be resolved in the courts located in Puerto Rico.
